Terms of use

Last updated: October 14, 2026

This is an English translation provided for convenience. In case of any discrepancy, the French version prevails.

These general terms of use (the “Terms”) govern access to and use of the website grainequipousse.com and of its French version grainequipousse.fr (the “Site”) and of the application app.grainequipousse.fr (the “Service”). By creating an account or using the Service, you accept these Terms without reservation.

1. Publisher and legal notice

The Site and the Service are published by BRIXEL, a simplified joint-stock company with a single shareholder (SASU) with share capital of €1,000, registered with the Trade and Companies Register under number 940 320 641 (R.C.S. Antibes), with its registered office at 67 boulevard du Val Claret, 06600 Antibes, France.

  • SIRET: 940 320 641 00019 — APE code: 6201Z (computer programming)
  • Publication director: Justin Grivon
  • Contact: justin@brixel.ai
  • Hosting provider: OVH SAS, 2 rue Kellermann, 59100 Roubaix, France (SAS with share capital of €10,174,560, RCS Lille Métropole 424 761 419) — www.ovhcloud.com. Media are stored with Amazon Web Services, Paris region (eu-west-3).

2. Purpose of the Service

graine qui pousse is a tool for automating your social media presence, powered by artificial intelligence. From a simple address (domain name, Google Business Profile or company name), the Service:

  • builds a brand dossier from publicly available information (website, business listing, public social media profiles, market, competitors);
  • generates content proposals (text, images, videos, carousels) tailored to each network;
  • after your approval, schedules and publishes them on the accounts you have connected;
  • reports the statistics of the posts thus published.

3. Account and eligibility

The Service is reserved for professionals (companies, self-employed individuals, associations) acting in the course of their business, represented by an adult natural person with the authority to bind them.

  • Creating an account requires a name, a valid email address and a password. You agree to provide accurate information and to keep it up to date.
  • You are solely responsible for the confidentiality of your credentials and for any activity carried out from your account. Notify us without delay of any unauthorized use.
  • Access may be opened gradually, in particular through a waitlist or a named, single-use and personal invitation.

4. Connecting your social networks

To publish on your behalf, you connect your accounts through the OAuth protocol of the platforms concerned (Instagram, Facebook, Threads, LinkedIn, TikTok, YouTube). This connection is optional, limited to the accounts you choose, and revocable at any time.

  • You warrant that you are the holder of the connected accounts, or a duly authorized administrator of them, and that you have the right to publish on them.
  • You authorize us to publish, on your behalf and on your instructions, the content you approve or whose scheduling you approve, and to read the statistics of the posts thus published.
  • No post is published without your approval or without the scheduling you have approved.
  • Use of the Service remains subject to each platform’s own terms, which you agree to comply with, in particular Meta’s terms and those of LinkedIn, TikTok and YouTube. By connecting a YouTube channel, you expressly accept the YouTube Terms of Service.
  • The platforms may modify, restrict or discontinue access to their APIs, refuse a post or suspend an account, and we cannot be held liable on that account.

5. AI-generated content

The Service produces content proposals using generative AI models. You acknowledge and accept the following.

  • Generated content consists of proposals: they are submitted to you before any publication and are only published after your approval.
  • AI may produce results that are inaccurate, incomplete, inappropriate or unintentionally similar to existing content. It is your responsibility to review and check each piece of content before publishing it, in particular factual statements, prices, regulatory notices and commercial claims.
  • You remain the author of, and responsible for, the content you publish. You are responsible for its compliance with applicable law (advertising, consumer law, intellectual property, image rights) and with the platforms’ rules.
  • We do not guarantee that generated content is eligible for protection by copyright or that it is free of third-party rights.
  • Your content is not used to train AI models (see the privacy policy).

6. Ownership of your content

You retain full ownership of the content you upload (photos, videos, logos, text) and, to the extent permitted by applicable law, of the content generated at your request. You grant us only the non-exclusive license, limited to providing the Service and for its duration, needed to host, process, adapt to the platforms’ formats and publish this content on your instructions. This license ends when the content or your account is deleted.

You warrant that you hold the rights to any element you upload and that its publication does not infringe any third-party rights.

7. Acceptable use

You agree not to use the Service to:

  • publish content that is unlawful, defamatory, hateful, harassing, violent, pornographic or misleading, or that infringes the rights of third parties;
  • distribute spam, engagement manipulation content, disinformation, or any content prohibited by the platforms’ rules;
  • impersonate a third party or publish on accounts you are not authorized to manage;
  • circumvent technical limits, probe, overload or disrupt the Service, extract its data on a massive scale, or reverse engineer it;
  • resell the Service or make it available to third parties without our written consent.

In the event of a breach, we may suspend or terminate your access, after a formal notice that has remained unheeded where the seriousness of the facts allows, and without notice in the event of a serious breach, unlawful activity or risk to the Service or to third parties.

8. Availability and changes

The Service is provided as is and is continuously being improved. We strive to ensure its availability but do not guarantee uninterrupted or error-free access: it may be suspended, in particular for maintenance, upgrades or security reasons. The Service depends on third-party providers (hosting, AI models, social network APIs) whose unavailability may affect it.

The Service may change, and some features may be modified or removed. In the event of a substantial and unfavorable change, we will inform you by appropriate means.

9. Financial terms

The Service is currently made available free of charge, during an early-access phase. Any introduction of a paid offer will be announced in advance and will be subject to separate general terms of sale; no amount may be charged to you without your express consent.

10. Personal data

The processing of your personal data, including the data from the social networks you connect, access tokens, and the data sent to AI models, is described in our privacy policy, which forms an integral part of these Terms.

11. Term, termination and deletion

  • These Terms apply for as long as you have an account. You may stop using the Service at any time, disconnect your networks under “Connected accounts”, and delete your brands in the app.
  • To delete your account and all your data, email us at justin@brixel.ai from your account’s email address; deletion takes place within a maximum of 30 days.
  • Posts already published on your networks stay online after termination: they belong to you and can be deleted from the platform concerned.
  • We may terminate your access with reasonable notice, or without notice in the cases provided for in section 7.

12. Intellectual property of the Service

All elements of the Site and the Service (the graine qui pousse trademark, logo, text, visuals, animations, code, visual identity, databases) are protected by intellectual property law and remain the exclusive property of BRIXEL or its partners. These Terms grant you only a personal, non-exclusive and non-transferable right of use, for the duration of your access. Any reproduction, representation, extraction or exploitation, in whole or in part, without prior written authorization, is prohibited.

13. Liability

In providing the Service, BRIXEL is bound by an obligation of means (a best-efforts duty, obligation de moyens). It cannot be held liable for:

  • the content you approve and publish, or its consequences (commercial, reputational or legal);
  • the platforms’ decisions (refusal of a post, restriction, suspension or deletion of an account or of content);
  • indirect damage: loss of business, revenue, customers, data or reputation;
  • a force majeure event or a failure of a third-party provider.

To the extent permitted by law, and since the Service is currently provided free of charge, BRIXEL’s total liability, for all causes combined, is limited to the amounts you may actually have paid it during the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability in the event of gross negligence (faute lourde), willful misconduct (dol) or personal injury.

You agree to indemnify BRIXEL against any third-party claim arising from the content you publish or from a breach on your part of these Terms.

14. Changes to the Terms

BRIXEL may amend these Terms to reflect changes to the Service or to the regulations. In the event of a substantial change, you will be informed by email or in the app before it takes effect. Continued use of the Service after that date constitutes acceptance; otherwise, you may terminate your account.

15. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution; you can write to us at justin@brixel.ai. Failing agreement, and since the Service is intended for professionals, any dispute relating to the validity, interpretation or performance of these Terms will fall under the exclusive jurisdiction of the courts of Aix-en-Provence, notwithstanding multiple defendants or third-party claims (appel en garantie).

16. Contact

For any question about these Terms: justin@brixel.ai — BRIXEL, 67 boulevard du Val Claret, 06600 Antibes, France.
